Terms of Service

1. Acceptance of Terms

By accessing and using Kodifast ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Kodifast is a property management software platform that provides:

• Property and tenant management tools
• Lease tracking and management
• Payment processing and tracking
• Maintenance request management
• Document storage and management
• Reporting and analytics
• Communication tools between landlords and tenants

3. User Accounts and Registration

Account Creation

To use our service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be at least 18 years old or have legal authority to enter into this agreement
• Use the service in compliance with all applicable laws

Account Responsibility

You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any security breach.

4. Subscription Plans and Billing

Subscription Terms

• Subscriptions are billed monthly or annually as selected
• Payment is due in advance for each billing period
• Free trial periods may be offered for new users
• Usage limits apply based on your selected plan

Payment Processing

Payments are processed securely through Stripe. By providing payment information, you:

• Authorize us to charge your payment method for subscription fees
• Agree to pay all charges incurred on your account
• Understand that failed payments may result in service suspension
• Accept responsibility for any fees imposed by your payment provider

Cancellation and Refunds

• You may cancel your subscription at any time
• Cancellation takes effect at the end of your current billing period
• No refunds are provided for partial billing periods
• We reserve the right to terminate accounts for violation of these terms

5. Acceptable Use Policy

Permitted Uses

You may use Kodifast for:

• Managing your rental properties and tenants
• Processing legitimate rental payments
• Storing property-related documents and communications
• Generating reports for business purposes

Prohibited Uses

You may not use Kodifast to:

• Violate any local, state, national, or international law
• Discriminate against tenants based on protected characteristics
• Store illegal or harmful content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Use the service for any fraudulent purpose
• Share your account access with unauthorized parties

6. Data and Content

Your Data

You retain ownership of all data you upload to Kodifast. You grant us a limited license to process and store your data to provide the service. You are responsible for ensuring you have the right to upload and process all data in your account.

Data Security

We implement reasonable security measures to protect your data, but cannot guarantee absolute security. You are responsible for maintaining secure backups of important data.

Data Export and Deletion

You may export your data at any time during your subscription. Upon account termination, your data will be deleted within 30 days unless legally required to retain it.

7. Service Availability

We strive to maintain high service availability, but we do not guarantee:

• 100% uptime or uninterrupted service
• That the service will be error-free
• That all features will work in all environments
• Compatibility with all third-party services

We reserve the right to modify, suspend, or discontinue the service with reasonable notice.

8. Intellectual Property

The Kodifast service, including its software, design, and content, is protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of our service without explicit permission.

9. Limitation of Liability

To the maximum extent permitted by law, Kodifast shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the service.

Our total liability for any claims arising from these terms or the service shall not exceed the amount you paid for the service in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Kodifast from any claims, damages, or expenses arising from your use of the service, violation of these terms, or infringement of any third-party rights.

11. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

12. Dispute Resolution

Any disputes arising from these terms or your use of the service shall be resolved through binding arbitration in accordance with the laws of Tanzania. You waive any right to participate in class action lawsuits or class-wide arbitration.

13. Governing Law

These terms are governed by the laws of Tanzania. Any legal proceedings must be brought in the courts of Dar es Salaam, Tanzania.

14. Changes to Terms

We may update these terms from time to time. We will notify you of any material changes by email or through the service. Continued use of the service after changes constitutes acceptance of the new terms.

15. Termination

Either party may terminate this agreement at any time. Upon termination:

• Your access to the service will be discontinued
• Your data will be deleted within 30 days
• Outstanding fees remain due and payable
• These terms shall remain in effect for any surviving provisions
